See Trial Court Opinion, 11/18/16, at 4 (noting that Nathan Medsger was not an accident reconstruction expert and his testimony would not have been admissible at trial). At the very least, Appellants were entitled to introduce the photographs at trial and have the jury weigh the credibility of Matkovich's explanation of the accident within the context of this evidence.
